Reason to Gather: To effectively prepare your business for expected changes to new salary thresholds set to start July1, 2024.
New Rules:
- Increases salary threshold (employee must be paid more than this to be exempt from OT, assuming performing duties) in two steps:
- on July 1 salary threshold goes from current about $36K/year to about $44K/year;
- on January 1, 2025, salary threshold jumps again to about $58.6K/year (63% increase from current salary threshold)
- Highly compensated employee threshold (used for employees that only meet one of criteria for executive, administrative or professional classifications)
- goes from current about $107K to about $133K on July 1;
- and then to about $151K/year on January 1, 2025 (41% increase from current HCE threshold)
- Every three years, each July 1, the salary thresholds are adjusted for inflation with the first adjustment happening July 1, 2027.
- A legal challenge to the regulation is being set up.

Austin J. Longnecker is an associate in the Shuman Law firm's Winchester office. Mr. Longnecker attended law school at West Virginia University, where he graduated with a labor and employment concentration. He was a member of the national Lugar Trial team, the Executive Notes Editor of the West Virginia Law Review, and the President of the Student Bar Association.
